1. Acceptance of Terms

By downloading, installing, or using Study Buddy ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

If you are under 18 years of age, you must have your parent or guardian's consent to use this App. By using the App, you confirm that you have obtained such consent.

2. Service Description

Study Buddy is an educational application designed to help students prepare for Opportunity Class (OC) and Selective School entrance examinations in Australia. The App provides:

• Practice questions and guided learning for Mathematics, Thinking Skills, Reading, and Writing
• Exam simulations and timed tests
• Insights, progress tracking, and performance trends
• Skill Gym and targeted drills (including arithmetic and typing practice)
• Vocabulary learning activities
• Question Library access for browsing and search
• Buddy features and learning motivation tools
• AI-powered writing assessment (Pro feature)

Study Buddy is an independent educational tool and is not affiliated with, endorsed by, or officially connected to the NSW Department of Education or any government examination body.

3. User Eligibility

The App is designed for students preparing for OC and Selective examinations, typically aged 9-12 years. Children under 13 must have parental consent to use this App.

Parents and guardians are responsible for supervising their children's use of the App and ensuring appropriate usage.

4. Subscriptions and Payments

Study Buddy offers both free and premium (Pro) subscription options:

Free Access

• Access to core practice features
• Access to exam preparation features included in the free tier
• Insights and progress tracking features

Study Buddy Pro

• Additional premium features as shown in-app at time of purchase
• Writing assessment features
• Premium content and customization options

Subscription Terms

• Subscriptions are billed through your Apple ID account
• Payment is charged upon confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
• No refunds are provided for partial subscription periods

5. User Responsibilities

You agree to:

• Use the App only for lawful educational purposes
• Not share, distribute, or reproduce any content from the App
• Not attempt to reverse engineer, modify, or tamper with the App
• Not use the App in any way that could damage or impair its functionality
• Provide accurate information when required

6. Intellectual Property

All content within the App, including but not limited to questions, explanations, graphics, logos, and software, is the property of Study Buddy or its licensors and is protected by copyright and intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our App or its content without express written permission.

7. Disclaimers

Educational Content

• The App provides practice materials and is not a guarantee of examination success
• Content is designed to supplement, not replace, formal education
• We do not guarantee the accuracy or completeness of all content

AI Features

• AI-powered features provide automated feedback and assessment
• AI assessments are for educational guidance only and may not reflect official examination marking

Data and Identity

• The App does not require account-based identity for normal use
• We may not be able to identify specific users across all analytics records

The App is provided "as is" without warranties of any kind, either express or implied.

8. Limitation of Liability

To the maximum extent permitted by law, Study Buddy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

Our total liability shall not exceed the amount you paid for the App subscription in the twelve months preceding any claim.

9. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may stop using the App at any time. Cancellation of your subscription does not entitle you to a refund for the current billing period.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms within the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of New South Wales.
